OMG! Okay sending you to another person's journal here, because there's discussion going on and while I wouldn't advocate underage sex, nor do I read stories that contain underage sex, because *squick*, but I'm rather shocked that fanfiction could get you arrested. That's of course assuming it was fanfiction.

IN WHAT is considered a Territory first, a man has been sent to jail for possessing fictional text stories about sex with children.

I got the link via Amireal's journal and there's a discussion going on about it over here.

What gets me is that there were no pictures involved and yet they were able to arrest, fine and jail the man. Makes you wonder if other things that are considered socially inacceptable (slash/BDSM/smut), but wouldn't admit to in RL could land you in trouble. The way the judge gets all high and mighty is truly scary. I'm assuming in this case it was mainly because it contained underage sex, but it's still very interesting. Fanfiction has always been something that I would have assumed was fairly outside of the law in that sort of sense. (Unless the show's owners wanted to go nuts over the use of their characters or whatnot anyway.) Apparently it's not. I wonder about the HP fandom in particular. I'm not in the HP fandom at all, but I'm assuming there would be smut there, the same as in any other fandom and from the discussion going on, I'm right about that.

Anyway, I'm not condoning fic with underage sex, just rather interested by possible ramifications of such a ruling. Anyone got any further views or discussion on this?
